ORDINANCE NO. 256
AN ORDINANCE of the City Council of the City of Lakewood, Washington, vacating a portion of San Francisco Avenue
WHEREAS, the City Council of the City of Lakewood, Washington, has, after a review of its needs for streets and right-of-ways in the vicinity of San Francisco Avenue SW, located within the City of Lakewood, Washington, determined that consideration should be given to the vacation of the same; and,
WHEREAS, a public hearing was held in connection with the possible vacation, with notice having been provided pursuant to statute; and,
WHEREAS, a public hearing was held in connection with the possible vacation, with notice having been provided pursuant to statute; and,WHEREAS, the City Council of the City of Lakewood, Washington, has considered all matters presented at the public hearing on the proposed vacation, held on the 16th day of January, 2001, at the Lakewood City Council Chambers in Lakewood, Washington.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF LAKEWOOD, WASHINGTON DO ORDAIN as a non-codified ordinance as follows:
1. That of a portion of the San Francisco Avenue SW right-of-way, located within the City of Lakewood, Washington, described as follows:
PARCEL A:
COMMENCING ON THE SOUTHEASTERLY RIGHT-OF-WAY LINE OF PACIFIC HIGHWAY AT A POINT 2048.83 FEET SOUTHWESTERLY FROM THE INTERSECTION WITH THE EAST LINE OF SECTION 11, TOWNSHIP 19 NORTH, RANGE 2 EAST OF THE WILLAMETTE MERIDIAN, SAID POINT BEING ON THE NORTHEASTERLY RIGHT-OF-WAY LINE OF SAN FRANCISCO AVENUE; THENCE S 48º 44' 00" W ALONG THE SOUTHWESTERLY RIGHT-OF-WAY LINE OF SAID PACIFIC HIGHWAY 31.19 FEET TO THE CENTERLINE OF SAN FRANCISCO AVENUE; THENCE S 57 06' 38" E ALONG SAID CENTERLINE 338.82 FEET TO A POINT ON THE NORTHWESTERLY LINE OF I-5 (AKA SCOTT ROAD, PRIMARY STATE HIGHWAY #1); THENCE N 51º 26' 15" E ALONG SAID RIGHT-OF-WAY LINE 31.64 FEET TO A POINT ON THE NORTHEASTERLY RIGHT-OF-WAY OF SAID SAN FRANCISCO AVENUE; THENCE N 57º 06' 38" W, 340.37 FEET TO THE POINT OF BEGINNING.
PARCEL B:
COMMENCING ON THE SOUTHEASTERLY RIGHT-OF-WAY LINE OF PACIFIC HIGHWAY AT A POINT 2080.02 FEET SOUTHWESTERLY FROM THE INTERSECTION WITH THE EAST LINE OF SECTION 11, TOWNSHIP 19 NORTH, RANGE 2 EAST OF THE WILLAMETTE MERIDIAN, SAID POINT BEING ON THE CENTERLINE OF SAN FRANCISCO AVENUE; THENCE S 48º 44' 00" W ALONG THE SOUTHWESTERLY RIGHT-OF-WAY LINE 31.19 FEET TO A POINT ON THE SOUTHWESTERLY RIGHT-OF-WAY LINE OF SAN FRANCISCO AVENUE; THENCE S 57º 06' 38" E ALONG SAID SOUTHWESTERLY RIGHT-OF-WAY LINE 337.27 FEET TO A POINT ON THE NORTHWESTERLY LINE OF I-5 (AKA SCOTT ROAD, PRIMARY STATE HIGHWAY #1); THENCE N 51º 26' 15" E ALONG SAID NORTHWESTERLY RIGHT-OF-WAY LINE 31.64 FEET TO A POINT ON THE CENTERLINE OF SAN FRANCISCO AVENUE; THENCE N 57º 06' 38" W, 338.82 FEET TO THE POINT OF BEGINNING,
located within the City of Lakewood, Washington, and as shown on the map attached hereto, marked Exhibit "A" and incorporated herein by this reference, be, and the same hereby is vacated, provided that the City of Lakewood reserves an easement for utilities over, under and on the vacated right-of-way, and further reserves the right to grant easements for utilities over, under and on the vacated right-of-way.
2. That this vacation shall be effective upon payment to the City of Lakewood, within 60 days of the date hereof by the owner or owners of property adjacent thereto and to be benefited by the vacation, in the total amount of Thirty-Five Thousand Four Hundred Ten ($35,410) dollars, and that this Ordinance shall be in full force and effect five (5) days after publication is required by law. If the above described payment is not made within the time period provided above, this Ordinance shall be null and void; and
3. That a copy of this Ordinance shall be filed with the Office of the Pierce County Assessor.
ADOPTED by the City Council this 16th day of January, 2001.
