RESOLUTION NO. 1998-28
A RESOLUTION of the City Council of the City of Lakewood, Washington, indicating their legislative intent regarding certain development regulations
WHEREAS, since its incorporation, the City Council for the City of Lakewood, Washington, has adopted numerous code provisions designed to enhance the quality of life by increasing standards related to landscaping, tree preservation, off site and on site standards as well as other areas; and,
WHEREAS, as part of these new standards the City Council adopted Section 18.35.140 and Chapter 12.03 of the Lakewood Municipal Code related to street standards, pedestrian facilities, and non motorized facilities; and,
WHEREAS, these standards and requirements were intended to apply universally to all type of development projects; and,
WHEREAS, the Council is aware of the Street Opening Permit issued on June 25, 1998 to Pierce County for the construction of sewer facilities to enable further development within the City of DuPont; and,
WHEREAS, the City Council has shown its support for the economic development of the region in several matters before the City including the Cross Base Highway and other sewer permitting issues which benefit areas outside Lakewood; and,
WHEREAS, the Council desires to facilitate further economic development in the DuPont areas, but intends, through enforcement of its various codes and regulations, to insure that such projects meet all standards and requirements of the City for those portions of the project within the corporate limits; and,
WHEREAS, the City Council has been made aware of an appeal of the permit conditions which would apply these various standards and requirements of the City to the project which is the subject of the permit.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF LAKEWOOD, WASHINGTON HEREBY RESOLVES, as Follows:
Section 1. The City Council has reviewed the conditions of Street Opening Permit No. 98-235 and find it to be totally consistent with the legislative intent of the City Council.
Section 2. In the absence of any agreement or other arrangements to address the impacts of the project involved with Street Opening Permit No. 98-235, the City Council intends that all appropriate Municipal Code sections apply to the project.
Section 3. That this Resolution shall be in full force and effect upon passage and signatures hereon.
