ORDINANCE NO. 539
AN ORDINANCE of the City Council of the City of Lakewood, Washington, amending the Official Zoning Map
WHEREAS, following public meetings and discussions and pursuant to the state Growth Management Act and the City of Lakewood Comprehensive Plan, the Lakewood City Council adopted Title 18A, Land Use and Development Code, of the Lakewood Municipal Code (LMC) via Ordinance No. 264 on August 20, 2001 (as subsequently amended); and
WHEREAS, LMC 18A.02.320 adopts by reference the Official Zoning Map maintained electronically within the City of Lakewood’s geographic information system; and
WHEREAS, LMC 18A.02.400 sets forth the process by which amendments may be made to the Land Use and Development Code, including the Official Zoning Map; and
WHEREAS, pursuant to the provisions within LMC 18A.02.400, a private individual has applied for rezoning of property within the Lakewood city limits and subject to the Official Zoning Map under project no. LU100150; and
WHEREAS, the Lakewood Planning Advisory Board (PAB), acting as the City’s designated planning agency and in keeping with authority granted by LMC 18A.02.410.C, has concurred with the addition of several surrounding properties to the proposed rezone, which is collectively known as the “Mazza rezone”; and
WHEREAS, public participation opportunities, as required by RCW 36.70A.130(2)(a), appropriate to the level of the amendment being reviewed, have been afforded to interested parties via open public meetings, mailings and site posting, and a public comment/hearing period, and public input received through these channels has been duly considered by the Lakewood PAB; and
WHEREAS, environmental review as required under the Washington State Environmental Policy Act has resulted in the issuance of a determination of environmental non-significance; and
WHEREAS, a 60-day notice has been provided to state agencies and state agencies have been afforded the opportunity to comment pursuant to RCW 36.70A.106(1); and
WHEREAS, following the public hearing, the Lakewood PAB passed a motion on July 6, 2011, recommending that the Lakewood City Council approve the Mazza rezone; and
WHEREAS, the Lakewood City Council has reviewed and considered public input, staff recommendations and PAB recommendations regarding the proposed Mazza rezone; and
WHEREAS, the Lakewood City Council, based on the above, has determined that it is appropriate to provide for the amendment of the Official Zoning Map; and
WHEREAS, the Lakewood City Council has considered the required findings in LMC 18A.02.415 as related to the proposed Mazza rezone, and hereby finds that the requirements of LMC 18A.02.415 are satisfied;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF LAKEWOOD, WASHINGTON, DO ORDAIN AS FOLLOWS:
Section 1. The Official Zoning Map of the City of Lakewood is hereby amended to zone the following subject property Mixed Residential 2 (MR2), as shown in Exhibit A hereto:

Section 2. Remainder Unchanged. The rest and remainder of the Official Zoning Map shall be unchanged and shall remain in full force and effect.
Section 3. Severability. If any portion of this Ordinance or its application to any person or circumstances is held invalid, the remainder of the Ordinance or the application of the provision to other persons or circumstances shall not be affected.
Section 4. Effective Date. This Ordinance shall be in full force and effect five (5) days after publication of the Ordinance Summary.
