RESOLUTION NO. 2010-29

 

A RESOLUTION of the City Council of the City of Lakewood, Washington, authorizing the City Manager to transfer real property located at 14514 Washington Avenue SW within the City to Habitat for Humanity for the purpose of constructing low-income eligible housing.

WHEREAS, on February 18, 2009, the City entered into an agreement with Washington State Department of Commerce to administer $626,793 in Neighborhood Stabilization Program (NSP) funds for the purpose of abating and/or acquiring and redeveloping vacant, abandoned or foreclosed properties; and,

WHEREAS, on September 7, 2010, the City, through Pierce County tax foreclosure surplus, acquired 14514 Washington Avenue SW for the purpose of transferring title to Habitat for Humanity to construct three low-income, single-family residences in the Tillicum community; and,

WHEREAS, the RCW 35A.11.010 allows code cities, such as Lakewood, to acquire real property and to convey or dispose of real property for the common benefit; and,

WHEREAS, property sold for the purpose of benefiting the poor and infirm is a permissible use of government funds under Article VIII, Section 7 of the Washington State Constitution; and,

WHEREAS, it is the stated belief of the City Council that this transaction will benefit the public in providing home ownership to low-income families, through revitalizing an abandoned vacant  parcel of property that was at one time a blight upon and danger to the public health an safety; and,

WHEREAS, the City Council further believes that public benefit will be gained through this transfer by return of this property to the property tax rolls and alleviation of any future need to expend public funds toward maintenance or upkeep of the property.

NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF LAKEWOOD, WASHINGTON HEREBY RESOLVES AS FOLLOWS:

 

Section 1.  The City of Lakewood does find that the transfer of real property located at 14514 Washington Avenue SW within the City of Lakewood to Habitat for Humanity provides a common benefit to the public through the provision of low-income housing opportunities and the revitalization of a single family residential neighborhood.

 

Section 2.  The Lakewood City Council hereby authorizes the City Manager to facilitate this action and to execute all documents necessary to finalize the transfer of this property to Habitat for Humanity for the construction and redevelopment of three low-income, single-family residences with and the expenditure of NSP funds of up to $155,113 for this purpose.

 

Section 3.    This Resolution shall be in full force and effect upon passage and signatures hereon.
