CALL TO ORDER
Mayor Richardson called the meeting to order at 7:00 p.m.
Councilmembers Present: 7 ? Mayor Douglas Richardson; Deputy Mayor Don Anderson; Councilmembers Mary Moss, Mike Brandstetter, Jason Whalen, Walter Neary and Claudia Thomas.
The Pledge of Allegiance was led by Mayor Richardson.
REPORTS BY THE CITY MANAGER
City Manager Neiditz reported that there were three Lakewood businesses located at the 8400 block of South Tacoma Way destroyed by fire on January 18, 2010. There has been no official determination on the cause of the fire as of yet.
City Manager Neiditz announced that a groundbreaking ceremony of the Pacific Highway Ponders Corner project will be held tomorrow, January 20, 2010, at 11:30a.m.
City Manager Neiditz reported that the Police Chief was invited by the Governor to address the Legislature on a number of State law enforcement proposals regarding bail reform, benefits to survivors lost in the line of duty and others. With regards to the gambling issue, he indicated that that legislation has been introduced to allow cities to impose some limitations. With regards to public records legislation, he noted that testimony has been provided by the Association of Washington Cities and others.
PROCLAMATIONS AND PRESENTATIONS
Proclamation declaring January 2010 as School Board Appreciation Month.
Deputy Mayor Anderson presented a proclamation declaring January 2010 as School Board Appreciation Month to Dr. Marty Schafer, President of the Clover Park School District Board. Discussion ensued about collaborating on a joint resolution relative to the opposition of the Pt. Defiance Bypass railroad crossing project.

Speaking before the Council were:
Dennis Haugen, Lakewood resident, spoke about newspapers not doing investigative reporting about government officials.
Matt Sygny, Midland, Washington, questioned why Morris Quimby is being allowed to continue to serve on the Public Safety Advisory Committee since he pulled a gun on Mr. Congo Carter.
Dennis Jefferson, Tillicum resident, questioned why there can be no justice and asked if the Mayor was true to the comments THE NEWS TRIBUNE printed. He expressed concern on how Mr. Congo Carter suffered injustice and insult to injury.
Congo Carter, Tillicum resident, expressed concern about Morris Quimby continuing to serve on the Public Safety Advisory Committee. He asked that the Mayor do what is right and that justice is done.
Jim Taylor, Lakewood resident, spoke about the opposition of the Pt. Defiance Rail Bypass project in Lakewood.
Andrew Wood, Washington State Department of Transportation, provided an update of the Pt. Defiance Rail Project and explained that portions of the project are underway. He indicated that $2.1 million dollars in sales tax revenues will be generated and 635 jobs will be created within two years to Lakewood.

PUBLIC HEARINGS AND APPEALS
This is the date set for a public hearing by the City Council to extend the interim zoning controls for eating and drinking establishments greater than 10,000 square feet of interior space within the neighborhood commercial and central business zoning districts for an additional six months.
Speaking before the Council were:
Dennis Haugen, Lakewood, resident, spoke about gambling and stopping the City Manager from lobbying relative to gambling.
Written testimony from Josh McDonald was distributed to the Council and provided for the record.
There being no further testimony, the hearing was declared closed.
Motion No. 2010-05 appointing Deputy Mayor Don Anderson, Councilmember Jason Whalen and Mayor Douglas Richardson (alternate) to serve as Lakewood?s representatives on the Pierce County Regional Council.
COUNCILMEMBER NEARY MOVED TO CONFIRM THE APPOINTMENT OF DEPUTY MAYOR DON ANDERSON, COUNCILMEMBER JASON WHALEN AND MAYOR DOUGLAS RICHARDSON (ALTERNATE) TO SERVE AS LAKEWOOD?S REPRESENTATIVES ON THE PIERCE COUNTY REGIONAL COUNCIL. SECONDED BY COUNCILMEMBER moss. VOICE VOTE WAS TAKEN AND CARRIED UNANIMOUSLY.

Ordinance No. 509 amending Chapter 8.76 of the Lakewood Municipal Code relative to gender equity, infraction fees, liability insurance and alcohol in parks.

DEPUTY MAYOR ANDERSON MOVED TO ADOPT RESOLUTION NO. 2010-03. SECONDED BY COUNCILMEMBER BRANDSTETTER. VOICE VOTE WAS TAKEN AND CARRIED UNANIMOUSLY.
Motion No. 2010-06 approving the Shoreline Management Plan Update Public Participation Plan.
COUNCILMEMBER whalen MOVED TO APPROVE THE SHORELINE MANAGEMENT PLAN UPDATE PUBLIC PARTICIPATION PLAN. SECONDED BY COUNCILMEMBER thomas. VOICE VOTE WAS TAKEN AND CARRIED UNANIMOUSLY.
BRIEFING BY THE CITY MANAGER
City Manager Neiditz indicated that he has been reviewing the facilitator?s report on the Council?s Retreat which will be forwarded to the Council shortly.

City Manager Neiditz announced that the Association of Washington Cities Legislative Action Conference will be held on Wednesday and Thursday, January 27-28, 2010, should any Councilmember be interested in attending.
City Manager Neiditz reported on the State Auditor?s report on the City?s financial audit.
City Manager Neiditz commented on the Community Development Department?s outreach to the Korean community and that staff has been invited to make a presentation about building contracts.
City Manager Neiditz indicated that he is currently reviewing the year-end budget and implications for 2010.
City Manager Neiditz indicated that there had been comments about placing completed public records requests on the website, and explained that there are documents that are sensitive relative to privacy acts and notification to third parties.
City Manager Neiditz explained that, for the Council Study Session room layout, City staff is proposing to continue the Study Sessions in the Council Chambers with Councilmembers sitting at the Council dais. He indicated that when there are joint meetings with the citizens advisory committees and boards and other boards such as the Clover Park School District Board, he proposed that such meetings be held at the Police Station multi-purpose room. Council concurred with the staff?s recommendation, and asked that more notice be provided to citizens when the multi-purpose room is used.
CITY COUNCIL COMMENTS
Councilmember Moss announced that the Partners for Parks? Black Tie & Blue Jeans event will be held on March 6, 2010, at the McGavick Center.
Councilmember Moss announced that Communities In Schools will be holding their Champions for Breakfast event on March 4, 2010 at the Old Country Buffet.
Councilmember Neary commented on HB 2736 addressing issues relative to open public records in helping citizens under the Public Records Act.
Councilmember Thomas reported that Ms. Jo Ethel Smith expressed her appreciation for the Council and citizens who participated in the Martin Luther King Jr. ceremony over the weekend.
Councilmember Thomas distributed copies of a Sound Transit report describing the milestones of their accomplishments.

Deputy Mayor Anderson commented on the Community Development Block Grant (CDBG) Citizens Advisory Committee meeting he attended and their discussion on using some of the CDBG funds for a small business loan program. He added that the Board indicated that they could not make recommendations about this program because they are not aware of the parameters of such a loan program.
Mayor Richardson asked if there had been any complaints about traffic flow at the Gravelly Lake Drive intersection due to street construction projects.
Mayor Richardson asked about the correspondence he received relative to the bid for Tillicum sewers, and asked if there were deadline parameters for protesters.
Mayor Richardson commented on the Office of Financial Management (OFM) count for the cities population and the US Census Bureau.
There being no further business, the meeting adjourned at 9:00 p.m.
