RESOLUTION NO. 2010-05

A RESOLUTION of the City Council of the City of Lakewood, Washington,

WHEREAS, on November 29, 2009 the City of Lakewood lost four police officers: Sergeant Mark Renninger, Officer Tina Griswold, Officer Ronald Owens and Officer Greg Richards, in the most tragic incident of this nature in Washington State history; and

WHEREAS, it was necessary and appropriate for the City to take action immediately in response to this tragedy; and

WHEREAS, the City Manager, in keeping with his lawful authority and acting on advice of Counsel and after staff consultation with representatives of the State Auditor, declared an emergency; and

WHEREAS, acting within said state of emergency the City Manager took whatever action was necessary to ensure proper response from the City, including those matters necessary to properly and timely memorialize the officers and tend to the emotional state of City staff and the community; and

WHEREAS, at no time did the City Manager exceed his usual spending authority but there may have been instances where time did not allow for the usual purchasing processes such as issuance of requests for bids or proposals; and

WHEREAS, for the City Manager to have complied with usual procedure would have jeopardized the proper, appropriate and adequate response of the City.

NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF LAKEWOOD, WASHINGTON HEREBY RESOLVES as follows:

Section 1. That the declaration of emergency, made by the City Manager in response to the deaths of Sergeant Mark Renninger, Officer Tina Griswold, Officer Ronald Owen and Officer Greg Richards, was an appropriate and authorized declaration which enabled the City to respond to an unforeseeable tragedy.

Section 2. That the actions taken and expenditures made by the City Manager in responding to the emergency generally fall within his daily authority and where processes were not followed, it was in the interest of responding timely to the emergency.

Section 3. That the declared emergency is terminated.

Section 4. Severability. If any sections, sentence, clause or phrase of this Resolution shall be held to be invalid or unconstitutional by a court of competent jurisdiction, or its application held inapplicable to any person, property or circumstance, such invalidity or unconstitutionality or inapplicability shall not effect the validity or constitutionality of any other section, sentence, clause or phrase of this Resolution or its application to any other person, property or circumstance.

Section 3. This Resolution shall be in full force and effect upon passage and signatures hereon.
