RESOLUTION NO. 2002-17

 

A RESOLUTION of the City Council of the City of Lakewood, Washington, setting a public hearing on the proposal to extend the moratorium on multi-family development in the Oak Park neighborhood

 

 

WHEREAS, the City of Lakewood became incorporated on February 28, 1996; and,

WHEREAS, in an attempt to address zoning and land use regulations in the City, the City Council adopted interim zoning and land development regulations patterned after those of Pierce County to operate until the City developed and adopted its permanent zoning regulations; and,

WHEREAS, after an extensive review process, and after significant efforts to incorporate the concerns of Lakewood citizens, the City Council adopted its first (non-interim) Comprehensive Plan by Ordinance No. 237 on the 10th day of July, 2000, and adopted its first (non-interim) Zoning and Land Use Code by Ordinance No. 264, on the 20th day of August, 2001; and,

WHEREAS, in connection with the development of said Ordinance No. 264, and in connection with the promulgation of a draft redevelopment plan, residents of the Oak Park neighborhood requested the City Council to study the zoning and land use designations designated for their neighborhood, further asking that the City Council consider changing the zoning and comprehensive planning designations from multi-family designations to single family designations; and,

WHEREAS, because of the time limitations on amendments of the Comprehensive Plan, the City Council placed a moratorium on the filing of applications for licenses, permits and approvals for residential development in the Oak Park area of the City, other than for single family residential use; and,

 

WHEREAS, the initial moratorium period expired on March 3, 2002; and,

WHEREAS, the City Council conducted a public hearing on February 19, 2002, and,

WHEREAS, the City Council on February 25, 2002, adopted Resolution No. 2002-06 extending the moratorium an additional six months; and,

WHEREAS, the moratorium was/is due to expire August 24, 2002; and,

WHEREAS, the redevelopment plan and land use amendment process is currently underway for the Oak Park neighborhood, but will not be completed prior to the expiration of the moratorium; and,

WHEREAS, the City Council desires to extend the moratorium until amendments to the land use designations for the Oak Park neighborhood have been implemented; and,

WHEREAS, Section 35A.63.220 of the Revised Code of Washington authorizes the City Council to extend moratoriums on interim zoning regulations after a public hearing has been held; and,

WHEREAS, a public hearing must be held prior to the adoption of this Resolution extending the moratorium.

NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF LAKEWOOD,

WASHINGTON, HEREBY RESOLVES as Follows:

 

Section 1. Public Hearing.

That a public hearing on the proposal to extend this moratorium will be held on the 5th day of August, 2002, at the City of Lakewood City Council Chambers, 6000 Main Street SW, Lakewood, Washington.

 

Section 2. Findings of Fact.

That, pursuant to RCW 35A.63.220, if after the public hearing the moratorium is renewed or extended, findings of fact shall be made to support such action.

 

Section 3. Severability.

If any sections, sentence, clause or phrase of this Ordinance shall be held to be invalid or unconstitutional by a court of component jurisdiction, or its application held inapplicable to any person, property or circumstance, such invalidity or unconstitutionality or inapplicability shall not effect the validity or constitutionality of any other section, sentence, clause or phrase of this Resolution or its application to any other person, property or circumstance.

 

Section 4. Effective Date.

That this Resolution shall be in full force and effect upon passage and signatures hereon.

 

PASSED by the City Council this 15th day of July, 2002.
