ORDINANCE NO. 491

AN ORDINANCE of the City Council of the City of Lakewood, Washington, amending Ordinance No. 480, the 2009 Budget Ordinance, originally adopted on December 1, 2008.

WHEREAS, pursuant to RCW 35, the City of Lakewood has created an annual budget with the most recent budget having commenced on January 1, 2009; and,

WHEREAS, the City of Lakewood has applied for and received a number of grants to enhance its activities for the benefit of the citizens; and,

WHEREAS, the City of Lakewood has changed certain operations in its Extra-Duty program for the Police Department; and,

WHEREAS, the City of Lakewood wishes to clarify its accounting by the creation of new funds to classify specific revenues and expenditures, it is appropriate at this time for the City Council to consider adjustments to the budget adopted for fiscal year 2009 to reflect adjustments necessary to accurately reflect revenues and expenditures for 2009.

NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF LAKEWOOD,

WASHINGTON DO ORDAIN as follows:

Section 1: Existing Fund Renamed. LMC 03.08.160 is hereby amended to read in its entirety: There is hereby established a fund to be known as the Narcotics Seizure Fund (Special Revenue Fund #180), that shall be used for the purposes of expenditures and revenues related to Police Department activities where the expenditures are governed by RCW 69.50.505.

Section 2: New Funds Established.

A .There is hereby established a fund to be known as the Felony Seizure Fund (Special Revenue Fund #181) that shall be used for the purposes of expenditures and revenues related to Police Department activities where the expenditures are governed by RCW 10.105.101.

B. There is hereby established a fund to be known as the Federal Seizure Fund (Special Revenue Fund #182) that shall be used for the purposes of expenditures and revenues associated with Police Department activities where the revenues are derived from Federal Law Enforcement Seizures.

C. There is hereby established a fund to be known as the Neighborhood Stabilization Grant Fund (Fund #191) that shall be used for the purpose of expenditures and revenues associated with the Federal Neighborhood Stabilization Program.

D. There is hereby established a fund to be known as the Office of Economic Adjustment Grant Fund (Fund #191) that shall be used for the purposes of expenditures and revenues associated with the Federal Office of Economic Adjustment Grant Program.

Section 3. Summary of Revenues and Appropriations. The adjusted 2009 total appropriations for all funds is $91,346,337. The adjusted total revenues for all funds is $91,346,337. The distribution of revenues and appropriations per fund is:

Section 4. Salary Ranges for New/Changed Employee Positions. The list of Employee Position Titles, Salaries, and Salary Ranges, in accordance with the amounts of employee salaries and costs in the 2009 budget, shall be added to and amended to reflect the following:

Section 5. Severability. If any section, sentence, clause or phrase of this Ordinance shall be held to be invalid or unconstitutional by a court of competent jurisdiction, or its application held inapplicable to any person, property or circumstance, such invalidity or unconstitutionality or inapplicability shall not effect the validity or constitutionality of any other section, sentence, clause or phrase of this Ordinance or its application to any other person, property or circumstance.

Section 6. Effective Date. This Ordinance shall be in full force and effect for the fiscal year 2009 and five (5) days after publication as required by law.
