RESOLUTION NO. 1997-22
A RESOLUTION of the City Council of the City of Lakewood, Washington, calling for a special election on the petition for annexation of the proposed annexation area identified as the Arrowhead/Partridge Glen annexation area, requesting that the special election shall be placed before the voters of the proposed annexation area on the 16th day of September, 1997, proposing language of the proposition therefor, and appointing persons to serve on the committees to draft the voter pamphlet statements for and against the proposed annexation
WHEREAS, the City of Lakewood received a petition filed with the Pierce County Auditor, filed under Auditor=s File Number 703240593, requesting annexation into the City of Lakewood of an unincorporated area contiguous to the corporate limits of the City, which unincorporated area is identified for reference as the Arrowhead/Partridge Glen Annexation area; and,
WHEREAS, as requested by the petition, the Lakewood City Council accepted and approved the petition by its Resolution No. 1997-9, passed on the 7th day of April, 1997, and forwarded the petition on to the Pierce County Boundary Review Board for approval, with the expectation that if the petition were so approved, the proposed annexation would be set for a special election before the voters of the annexation area, and if approved by such voters, that the City of Lakewood Council, adopt an Ordinance providing for the annexation of the real property of the annexation area; and,
WHEREAS, the City has been informed by the Pierce County Boundary Review Board that the Boundary Review Board's jurisdiction was not invoked, and that the annexation proposal was deemed approved by the Boundary Review Board; and,
WHEREAS, pursuant to Section 29.13.020 of the Revised Code of Washington (RCW), it is appropriate for the City Council to reaffirm its request, by this resolution, the calling of a special election on the proposed annexation, and further requests that the election be on the date selected as the day of the primary election for 1997, as specified by RCW 29.13.070, to wit: September 16, 1997; and,
WHEREAS, it is also appropriate for the City to provide proposed language for the title for the annexation proposition; and,
WHEREAS, pursuant to RCW 29.81A.070, it would also be appropriate for the City Council to appoint people to serve on the committees to draft the voter pamphlet statements for and against the annexation proposition.
NOW, THEREFORE, IT IS HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF LAKEWOOD, WASHINGTON, as follows:
Section 1. REQUEST FOR DATE FOR SPECIAL ELECTION ON ANNEXATION
The City Council of the City of Lakewood requests that the Pierce County Auditor place the special election on the proposed annexation on September 16, 1997 the date of the primary election for 1997 as specified by RCW 29.13.070, and, if approved by a majorityof the voters, with the annexation being effective upon certification of the annexation election by the Pierce County Auditor.
Section 2. LEGAL DESCRIPTION FOR PROPOSED ANNEXATION AREA
The area of the proposed annexation includes the territory within the boundary hereinafter described, all located in the County of Pierce, State of Washington, as follows:
Commencing at the southeast corner of Section 6, Township 19 N, Range 2 E, WM; thence north along the east line of Section 6, Township 19 N, Range 2 E, WM, a distance of 1,257.96 feet, to the southeast corner of the Crest Addition as recorded under AFN 2256936; thence westerly along the south boundary of said Crest Addition, a distance of 823.65 feet to the southwest corner of the said Crest Addition being the True Point of Beginning;
From POB to Far West Drive SW:
Said southwest corner being 31.13 feet southerly of the southeast corner of the intersecting boundary of the Town of Steilacoom, (southeast corner of the Balch DLC), and the Fort Lewis boundary; thence northerly along the west boundary of said Crest Addition a distance of 614.5 feet to the northwest corner of said Crest Addition, being the southwest corner of the Bills DLC; thence easterly along the south boundary of the Bills DLC a distance of 2,589 feet more or less to the southeast corner of the Bills DLC; thence northerly along the east boundary of said DLC to the center line of the right of way of Mt. Tacoma Drive SW (96th street), being a turning point for the Town of Steilacoom boundary; thence easterly along said centerline to the centerline of the right of way of Judson Road SW (108th Avenue), being a turning point for the Town of Steilacoom boundary; thence northerly 518 feet to a point 15 feet easterly of the southeast corner of Lot 10, Block 4 of Jaeger=s Addition, being a turning point for the Town of Steilacoom boundary; thence westerly 15 feet to the east boundary of said addition, also being a turning point for the Town of Steilacoom boundary; thence northerly a distance of 425 feet more or less to the south boundary of Schwab=s Cherry Hill Plat, being a turning point of the Town of Steilacoom boundary; thence easterly a distance of 115 feet more or less to the east boundary of said plat, being a turning point for the Town of Steilacoom boundary; thence northerly along the said east boundary of the Schwab=s Cherry Hill Plat and the extension thereof a distance of 534 feet to the center of the right of way of Marietta Street SW, being a turning point for the Town of Steilacoom boundary; thence easterly a distance of 858.60 feet to the east right of way line of Carver Road SW, said point being 660 feet west of the west right of way line of Farwest Drive SW, being a turning point for the Town of Steilacoom boundary; thence northerly a distance of 660 feet to the south boundary of Van Buskirk DLC; thence 660 feet easterly to the northeast corner of Government Lot 9, Section 32, Township 20 N, Range 2 E, WM said northeast corner being on the west right of way line of Far West Drive SW and also being a turning point for the Town of Steilacoom boundary;
Far West Drive SW to POB:
Thence southerly 3,220 feet more or less along the westerly right of way of Far West Drive SW to the northwest corner of Lot 1, Block 52 of the Replat of a Portion of Southern Pacific Town Company=s First Addition to Steilacoom; thence easterly 25 feet more or less to the northeast corner of Lot 1, Block 52 of the Replat of a Portion of Southern Pacific Town Company=s First Addition to Steilacoom; thence southerly 109 feet to the intersection of the south line of Block 57 of the Replat of a Portion of Southern Pacific Town Company=s First Addition to Steilacoom; thence westerly 1,250 feet along the southern boundary of the Replat of a Portion of Southern Pacific Town Company=s First Addition to Steilacoom to the intersection with the north-south center line of Section 5, Township 19 N, Range 2 E, WM, being the southwest corner of Block 55 of the Replat of a Portion of Southern Pacific Town Company=s First Addition to Steilacoom; thence westerly 30 feet to the northeast corner of Lot 29, Block 2 of Arrowhead Estates 11th Addition; thence southerly 1,560 feet to an angle point on the westerly right of way of 107th Avenue SW; thence southeasterly 630 feet more or less along said westerly right of way of 107th Avenue SW to the intersection with the center line of Old Military Road SW; thence westerly along said center line of Old Military Road SW to the intersection with the north-south center line of Section 5, Township 19 N, Range 2 E, WM; thence southerly along said north-south center line of Section 5 to the southeast corner of the southwest quarter of Section 5, Township 19 N, Range 2 E, WM; thence westerly along the south line of said Section 5, to the southwest corner of said Section 5, also being a turning point on the Fort Lewis boundary; thence northerly along the west line of Section 5, Township 19 N, Range 2 E, WM, a distance of 1,257.96 feet, to the southeast corner of the Crest Addition as recorded under AFN 2256936; thence westerly along the south boundary of said Crest Addition, a distance of 828.96 feet to the southwest corner of the said Crest Addition, being the Point of Beginning.
Section 3. OFFICIAL BALLOT TITLE - ANNEXATION PROPOSITION
That the official ballot title and language for the annexation proposition, prepared by the City Attorney for the City of Lakewood, be, and the same hereby is as follows:
ANNEXATION OF AREA KNOWN AS ARROWHEAD/PARTRIDGE GLEN
Shall the area of unincorporated Pierce County contiguous to the City of Lakewood commonly known as Arrowhead/Partridge Glen, described in Pierce County Boundary Review Board file No. A-97-3, be annexed to and become a part of the City of Lakewood, and subject to the zoning and land use regulations of the City of Lakewood, with property in the annexed area being taxed at the same rate as other property within the City of Lakewood?
EXPLANATORY STATEMENT
Currently, the area proposed for annexation to the City of Lakewood is in unincorporated Pierce County. The area of the proposed annexation is not only contiguous to Lakewood, it is easily accessible through City Streets to the City of Lakewood. If this annexation proposition is approved by a majority of the voters in the annexation area, this area will become a part of the City of Lakewood. Currently, most of the services provided to the annexation area are received from the same source that they would if the annexation is approved. These services would include: Emergency Medical Services and Fire Protection (provided by the Lakewood Fire District), Police/Law Enforcement (provided by the Lakewood Police Department through a contract with the Pierce County Sheriff=s Department). Other services that, upon annexation, would continue with the same provider are Solid Waste, Water, Sewer, Library, Schools, Electricity, Natural Gas and Telephone. Services that would change upon annexation would be Storm Drainage, Streets, Land Use and Building and Permit Services (from Pierce County to the City of Lakewood). Upon annexation, the Pierce County Road Tax would be eliminated, and the City of Lakewood Property Tax would be added. The 1997 Pierce County road tax rate for the annexation area, as a part of unincorporated Pierce County is $2.2165 per $1,000 of assessed valuation. The 1997 property tax rate for the City of Lakewood is $1.6006 per $1,000 of assessed valuation.
Section 4. APPOINTMENT OF PEOPLE FOR VOTER PAMPHLET STATEMENTS
That the City Council proposes and appoints the following persons to serve on the committees to draft the statements for and against the annexation proposition as may be published in the Voter's Pamphlet and/or other appropriate voter information:
