City Council meeting minutes of March 17 2008


A Resolution of the City Council of the City of Lakewood, Washington, setting a public hearing on April 21, 2008, for consideration of a development agreement between the City and Centerforce, Inc.

WHEREAS, Centerforce, Inc., provides occupational training for developmentally disabled persons and has approached the City of Lakewood with a project proposal whereby Centerforce would build a large-scale pet services center in an area of the City zoned for Neighborhood Commercial uses; and,

WHEREAS, depending upon the size and nature of the building project and subsequent use, this venture, if allowed, may conflict with the requirements and restrictions applicable to the Neighborhood Commericial zoning district; and,

WHEREAS, under title 36.70B of the Revised Code of Washington, and section 18A.10.600 of the Lakewood Municipal Code, the details of such a proposal may be negotiated between the City and Centerforce through a mechanism known as a development agreement; and,

WHEREAS, in order to gain a full understanding of the project, to study and appreciate the impacts this proposal would have upon neighboring property owners, and to determine whether a development agreement is an appropriate tool to utilize in this instance, the City Council of the City of Lakewood does hereby set a public hearing to consider this matter.


Section 1. Public Hearing Set. That a public hearing shall be held regarding the Centerforce proposal to establish a pet services center in an area of the City zoned for Neighborhood Commercial uses. This hearing is set for Monday, April 21, 2008, at 7 p.m. in the City of Lakewood City Council Chambers.

Section 2. Notice of Hearing. Notice of this hearing shall be disseminated at the discretion of the City Manager, or the designee thereof, with the intention of informing persons who own or occupy property in the vicinity of the proposed project of the nature and time of this hearing. Further, notice also shall be designed to inform interested parties and the general public of this public hearing. The notice shall include instructions for the submission of written or oral comments regarding the Centerforce proposal and opportunities for interested persons to gain additional information.

Section 3. Procedure at Hearing. At this public hearing the City Council will be obliged to consider a report from the City?s staff regarding this proposal, testimony from the project proponent, and public testimony. Consideration of this proposal shall be conducted in light of the requirements of state law and the provisions of the Lakewood Municipal Code.

Section 4. Consideration of Development Agreement. Conducting this public hearing does not obligate the City to acceptance or negotiation of a development agreement with the project proponent. The City Council must necessarily consider the best interests, safety and well being of the entire community as related to this proposal.

Section 5. This Resolution shall be in full force and effect upon passage and signatures hereon.
