RESOLUTION NO. 2008-09
A RESOLUTION of the City Council of the City of Lakewood, Washington, setting a public hearing on May 5, 2008, to consider the vacation of a portion right of way on 75th Street West
WHEREAS, the City of Lakewood, Washington, has received a petition to vacate unimproved right of way located on 75th Street West within the City; and,
WHEREAS, a private entity, 74th Street West, LLC, submitted this petition, seeking to purchase and incorporate the road right of way into a proposed development project; and,
WHEREAS, pursuant to Section 35.79.010 of the Revised Code of Washington and Lakewood Municipal Code Chapter 12.20, a hearing on such vacation shall be set by Resolution, with the date of such hearing being not more than sixty (60) days nor less than twenty (20) days after the date of passage of such Resolution; and,
WHEREAS, under Lakewood Municipal Code section 12.20.080, the City Manager, or the designee thereof, shall prepare a report concerning the proposed vacation for the City Council that will be used in considering whether to vacate the property, with a copy of the report to be served upon the representative of the petitioners, at least five days prior to the hearing; and,
WHEREAS, after passage of this Resolution, notice of this hearing shall be given as required under state and local laws.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF LAKEWOOD, WASHINGTON HEREBY RESOLVES as follows:
Section 1. That a hearing on the petition for vacation of a portion of the 75th Street West right of way, located within the City of Lakewood, Washington, described as follows:
THAT PORTION OF PROPERTY LYING WITHIN THE NORTHWEST QUARTER AND THE NORTHEAST QUARTER OF THE SOUTHEAST QUARTER OF SECTION 26, TOWNSHIP 20 NORTH, RANGE 2 EAST, W.M., IN PIERCE COUNTY, WASHINGTON, DESCRIBED AS FOLLOWS:
BEGINNING AT THE SOUTHEAST CORNER OF LOT 1 OF PIERCE COUNTY SHORT PLAT RECORDED JULY 02, 1987 UNDER RECORDING NO. 8707020523, IN PIERCE COUNTY, WASHINGTON; THENCE NORTH 89?04?22? WEST ALONG THE SOUTH LINE OF SAID LOT 1, A DISTANCE OF 259.16 FEET TO THE SOUTHWEST CORNER OF SAID LOT 1; THENCE SOUTH 00?55?38? WEST PERPENDICULAR TO THE SOUTH LINE OF SAID LOT 1, A DISTANCE OF 10.00 FEET; THENCE SOUTH 89?04?22? EAST PARALLEL WITH THE SOUTH LINE OF SAID LOT 1, A DISTANCE OF 276.12 FEET; THENCE NORTH 01?20?57? EAST, A DISTANCE OF 10.00 FEET, ALONG THE EAST LINE OF VACATED ALLEY AS DESCRIBED UNDER AFN 2342422; THENCE NORTH 89?04?22? WEST, A DISTANCE OF 20.00 FEET, TO THE POINT OF BEGINNING.
And the same hereby is set for 7:00 p.m. on the 5th day of May, 2008, or as soon thereafter as the matter may be heard, at the City Council Chambers at 6000 Main Street SW, Lakewood, Washington.
Section 2. That this Resolution shall be in full force in effect upon passage and signatures hereon.
