A RESOLUTION of the City Council of the City of Lakewood, Washington, initiating an action to vacate a portion of the Fairlawn Drive SW right-of-way and establishing February 4, 2008, as the date for a public hearing to consider this vacation

WHEREAS, the City of Lakewood, Washington, is responsible for designing and bringing forth roadway improvement projects that protect the public health, safety and welfare through increased vehicular and pedestrian traffic safety; and,

WHEREAS, the City?s Public Works staff is in the process of designing a sidewalk improvement project along the North side of Steilacoom Boulevard, beginning at Fairlawn Drive SW and extending to Bridgeport Way SW; and,

WHEREAS, this project will involve the acquisition of private property for right-of-way purposes, the cost of which may be partially offset by the vacation of existing right-of-way; and,

WHEREAS, pursuant to Section 12.20.030 of the Lakewood Municipal Code, the City Council of the City of Lakewood may initiate the vacation of property by Resolution, which resolution must set a future date and time for the City Council to hear and consider the proposed vacation; and,

WHEREAS, pursuant to Section 35.79.010 of the Revised Code of Washington, a hearing on such a vacation shall be set with a hearing date not more than sixty (60) days nor less than twenty (20) days after the date of passage of such Resolution; and,

WHEREAS, as stated below, such a public hearing is hereby set as follows.


Section 1. That the City Council of the City of Lakewood does hereby authorize the initiation of an action to vacate right-of-way on Fairlawn Drive SW. The right-of-way proposed for vacation is specifically described in ?Exhibit A,? attached hereto and incorporated herein by reference.

Section 2. That the City Council for the City of Lakewood shall hear and consider the facts of this vacation at a public hearing to be held on Monday, February 4, 2008, at 7:00 p.m., or as soon thereafter as the matter may be heard, at the City Council Chambers at 6000 Main Street SW, Lakewood, Washington.

Section 3. That this Resolution shall be in full force in effect upon passage and signatures hereon.

Situate in the City of Lakewood, Pierce County, State of Washington, being a portion of the Northeast Quarter of the Southwest Quarter of Section 35, Township 20 North, Range 2 East, Willamette Meridian, more particularly described as follows:

A portion of public right-of-way adjacent to the Southern lot line of Lot 2, Block 38, of Plat of Lakewood Park, said plat recorded in Volume 12, of Pats, Pages 11, 12 and 13, Pierce County Records:

Commencing at the Southwest corner of said Lot 2, being a p9oint on the north Right-of-Way line of Fairlawn Drive SW; The TRUE POINT OF BEGINNING of the right of way to be vacated;

THENCE, Southerly 7.91 feet, along a line bearing South 00011?45?West, thence Southeasterly 46.03 feet along a line with a bearing South 80004?23? East, thence Southeasterly 46.12 feet along a line bearing South 76051?25? East, thence Northerly 19.82 feet along a line bearing North 00011?45? East, thence Northwesterly through a curve to the left having a radius of 777.23 feet, a central angle of 85048?48?, and an arc length of 90.19 feet; to the TRUE POINT OF BEGINNING .

The above described strip-of-land contains approximately 1268 square feet, more or less.
