ORDINANCE NO. 451
AN ORDINANCE of the City Council of the City of Lakewood, Washington, establishing a moratorium on the filing of applications for licenses, permits and approvals for new residential and commercial development in the City of Lakewood, and setting a public hearing therefore.
WHEREAS, since the City of Lakewood has begun the permitting and construction of a new sewer trunk line in portions of the Tillicum community within the City; and
WHEREAS, this development has already generated numerous inquiries and discussion about the potential of Tillicum; and
WHEREAS, the Community Development Department has on file a pre-application for new development in this area; and
WHEREAS, Tillicum has not experienced this amount of economic and redevelopment interest since incorporation; and
WHEREAS, because of a combination of factors such as geography, the way Tillicum was subdivided, and mapping discrepancies, options for effective planning for the surge in redevelopment interest are severely limited; and
WHEREAS, a moratorium on new residential and commercial development would allow the City the ability to effectively plan for the best outcome for the City of Lakewood, specifically, to determine how to best reconcile existing constraints on property in Tillicum with effectively planning for increased interest in development; and
WHEREAS, Section 35A.63.220 and 36.70A.390 of the Revised Code of Washington authorize the City Council to establish moratorium in order to consider zoning controls; and
WHEREAS, pursuant to Section 5A.63.220 and 36.70A.390 of the Revised Code of Washington, a public hearing must be held within sixty (60) days after the establishment of the moratorium.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF LAKEWOOD, WASHINGTON DO ORDAIN as follows:
Section 1. Moratorium established. That a moratorium is hereby established on the filing with the City or the Courts any application for licenses, permits and approvals for new commercial and residential development in the City of Lakewood, specifically that geographic area designated in Exhibit A, attached hereto and hereby incorporated.
Section 2. Term of Moratorium. The moratorium imposed by this Ordinance shall become effective on the date set forth below, and shall continue in effect for a period of six (6) months, unless repealed, extended or modified by the City Council after subsequent public hearing pursuant to RCW 35A.63.220.
Section 3. Setting Public Hearing. That a public hearing on the proposal to establish a moratorium on the filing with the City or the Courts of any applications for licenses, permits and approvals for any new residential or commercial development in the geographic area of the City specified in Exhibit A, attached hereto, is hereby set for 7:00 p.m., or as soon thereafter as the matter can be heard, at the Regular Meeting on the 20th day of August, 2007 at the City of Lakewood City Council Chambers, 6000 Main Street Southwest, Lakewood, Washington.
Section 4. Severability. If any portion of this Ordinance or its application to any person or circumstance is held invalid, the remainder of the Ordinance or the application of the provision to other persons or circumstances shall not be affected.
Section 5. Effective Date. That this Ordinance and the moratorium provided for herein shall be in full force and effect upon passage and signatures hereon.
