ORDINANCE NO. 433
An Ordinance of the City Council of the City of Lakewood, Washington, terminating the moratorium established in Ordinance No. 390 and previously extended pursuant to Ordinance Nos. 406 and 419, relating to permits for correctional facilities proposed in Public Institutional zoning districts.
WHEREAS, on August 15, 2005, the City Council for the City of Lakewood enacted Ordinance No. 390, whereby a moratorium was established upon licenses, permits and approvals for correctional facilities located within the City?s Public Institutional zoning districts; and,
WHEREAS, the moratorium established in Ordinance No. 390 was extended for two additional six-month terms through enactment of Ordinance Nos. 406 and 419; and,
WHEREAS, Ordinance No. 419 was adopted on July 17, 2006, leaving the moratorium in effect for six months thereafter; and,
WHEREAS, while said moratorium was in place, the City?s Planning Advisory Board conducted an extensive review of the Public Institutional zoning districts within the City, and the PAB?s efforts resulted in recommended findings and proposed amendments that were submitted to the Lakewood City Council; and,
WHEREAS, in Lakewood City Council Ordinance No. 423, enacted on September 5, 2006, amendments were made to Title 18A of the Lakewood Municipal Code, as such title relates to Public Institutional zoning districts within the City; and,
WHEREAS, Ordinance No. 423 completed the process and review for which the moratorium was necessary.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF LAKEWOOD, WASHINGTON DO ORDAIN AS FOLLOWS:
Section 1. Moratorium Terminated. The moratorium established in Ordinance No. 390 and extended in Ordinance Nos. 406 and 419 is no longer necessary and is hereby terminated.
Section 2. Severability. If any sections, sentence, clause or phrase of this Ordinance shall be held to be invalid or unconstitutional by a court of competent jurisdiction, or its application held inapplicable to any person, property or circumstance, such invalidity or unconstitutionality or inapplicability shall not effect the validity or constitutionality of any other section, sentence, clause or phrase of this Ordinance or its application to any other person, property or circumstance.
Section 3. Effective Date. That, upon passage and signatures hereon, this Ordinance shall be in full force and effect on the 25th day of December, 2006, and shall continue in effect as provided herein.
