RESOLUTION NO. 2006-35

A RESOLUTION of the City Council of the City of Lakewood, Washington, authorizing the City Manager to transfer real property located at 4508 Yew Lane SW within the City to Habitat for Humanity for the purpose of constructing low-income eligible housing

WHEREAS, on December 12, 2005, the City Council concurred with a proposal to purchase property at 4508 Yew Lane SW for the purpose of transferring title to Habitat for Humanity for use as a site to construct a home for a low income eligible family; and,

WHEREAS, the City of Lakewood funded the purchase of this property with grant funds earmarked for use to encourage low-income housing opportunities within the City; and,

WHEREAS, RCW 35A.11.010 allows code cities, such as Lakewood, to acquire real property and to convey or dispose of real property for the common benefit; and,

WHEREAS, it is the stated belief of the City Council that this transaction will benefit the public in providing home ownership to a low-income family, through revitalizing a vacant parcel of property that was once a blight upon and danger to the public safety and health; and,

WHEREAS, the City Council further believes that public benefit will be gained through this transfer through the return of this property to the property tax rolls and alleviation of any future need to expend public funds toward maintenance or upkeep of the property.

NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF LAKEWOOD, WASHINGTON DO RESOLVE AS FOLLOWS:

Section 1. The City of Lakewood does find that transfer of real property located at 4508 Yew Lane SW within the City of Lakewood to Habitat for Humanity does benefit the public through the provision of low-income housing opportunities and the revitalization of a single family residential neighborhood.

Section 2. The Lakewood City Council hereby authorizes City Manager Andrew Neiditz to facilitate this action and to execute all documents necessary to finalize the transfer of this property to Habitat for Humanity.

Section 3. This Resolution shall be in full force and effect upon passage and signatures hereon.
