RESOLUTION NO. 2006-27

              

A RESOLUTION of the City Council of the City of Lakewood, Washington, confirming the assessment of an additional amount of charges in the amount of $2,083.52 as a special assessment against property located at 3418 84th Street SW for abatement of a public nuisance and authorizing said charges to be certified for collection in the same manner as for property taxes


 
 WHEREAS, as shown in City of Lakewood Resolution No. 2006-11, the City previously expended $14,130.19 in public funds to abate dangerous buildings located upon private property at 3418 84th Street SW within the City; and,
WHEREAS, City of Lakewood Resolution No. 2006-11 and all attachments thereto are incorporated herein by this reference as if fully set forth herein; and,
WHEREAS, on September 18, 2006, after sufficient and legal notice was provided to the property owner, a second public hearing was held in the matter of abating a dangerous building located at 3418 84th Street SW within the City of Lakewood; and,
WHEREAS, after the City?s contractor had completed the work of abatement addressed in Resolution No. 2006-11, it is believed that unknown persons conducted additional work at this site and this additional work made the hole located upon the property unstable, dangerous, and a continuation of the nuisance that had once been corrected; and,
WHEREAS, under the circumstances it was appropriate to expend an additional $2,083.52 to abate this continuing nuisance at 3418 84th Street South to protect the public health, safety and welfare; and,
WHEREAS, abatement of public nuisances and procedures therefore are specifically enumerated and authorized under LMC 15.32, under the Uniform Code for the Abatement of Dangerous Buildings, under RCW 35.80.030, and under RCW 7.48; and,
WHEREAS, following said abatement, as authorized in pertinent codes and statutes, it is appropriate also for the City of Lakewood to seek recovery of the fees and charges expended in abating said nuisances, thereby recovering public funds used in this manner; and,
WHEREAS, an itemized statement of funds expended in this additional abatement is contained in the report of building official, attached hereto, incorporated herein, and marked as ?Exhibit A? to this Resolution and the same documents are on file with the Office of the City Clerk.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF LAKEWOOD, WASHINGTON HEREBY RESOLVES, as Follows:
Section 1.      That in protecting the public health, safety and welfare, it was necessary to take additional action to abate nuisance conditions related to dangerous buildings formerly located upon property located at 3418 84th Street South within the City of Lakewood, Washington.  It is further appropriate to certify and confirm the assessment of charges for this abatement against the property, recording an additional assessment of $2,083.52 on the county tax assessment rolls, and thereafter creating a special assessment against and a lien upon the property for this amount.  Further, upon the passage of this resolution and thirty (30) days, as allowed under the Uniform Code for the Abatement of Dangerous Buildings, the special assessment shall bear interest at the rate of seven (7) percent per year from and after that date.
Section  2.     That this Resolution shall be in full force and effect upon passage and signatures hereon.
