RESOLUTION NO. 2006-19

              

A Resolution of the City Council of the City of Lakewood, Washington, setting a public fact finding hearing pursuant to RCW 35A.63.220 and 36.70A.390, regarding the moratorium established pursuant to Ordinance No. 390 and extended in Ordinance No. 406


 
 WHEREAS, on August 15, 2005, the City of Lakewood enacted Ordinance No. 390, a moratorium upon the filing of applications for licenses, permits and approvals for correctional facilities located within the Public Institutional zoning districts of the City; and,
WHEREAS, on February 6, 2006, the moratorium commenced in Ordinance No. 390 was extended for an additional six month period in Ordinance No. 406; and,
WHEREAS, pursuant to RCW sections 35A.63.220 and 36.70A.390, a moratorium may not be effective for longer than six months unless a subsequent public hearing is held and findings of  fact are made prior to each renewal; and,
WHEREAS, it is the intent of the City Council of the City of Lakewood to hold a public hearing regarding this moratorium to determine whether the moratorium should be continued or allowed to expire.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF LAKEWOOD, WASHINGTON, DOES ORDAIN AS FOLLOWS:


 

Section 1.      Public Hearing Set. That a public hearing shall be held regarding the moratorium established in Ordinance No. 390 and extended in Ordinance No. 406, which is hereby set for the Wednesday, July 5, 2006, at 7 p.m. in the City of Lakewood City Council Chambers.
Section 2.      Findings of Fact.  Pursuant to RCW sections 35A.63.220 and 36.70A.390,  the moratorium created under Ordinance No. 390 and extended in Ordinance No. 406 may be continued, extended or renewed only upon additional findings of fact, and the purpose for the hearing set herein is to consider whether the moratorium previously enacted should be renewed, extended, modified or abandoned.
Section 3.      This Resolution shall be in full force and effect upon passage and signatures hereon.
